The Platform is operated by SCANEX DIGITAL LTD, a company registered in England and Wales (company number 17326146), with its registered office at 3rd Floor, Old Stock Exchange, St Nicholas Street, Bristol BS1 1TG, United Kingdom ("ScanEX", "we", "us").

By accessing or using ScanEX ("the Platform", "our Services"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you must immediately discontinue use of the Platform.

We reserve the right to modify these Terms at any time. Continued use of the Platform after changes are posted constitutes your acceptance of the revised Terms.

2. Description of Service

ScanEX is a real-time cryptocurrency market monitoring and data intelligence platform. The Platform provides:

• Real-time price and volume data aggregated from third-party cryptocurrency exchanges
• Algorithmic signal detection tools (Live Movers, Trade Signals, Live Spikes, Breakout, and others)
• Market breadth and sector analysis dashboards
• AI-assisted token analysis powered by third-party AI providers (the "Alex" feature)
• Data visualization tools and related features

The Platform is provided solely as an informational and analytical tool. It is not a brokerage, exchange, financial institution, or investment adviser.

3. Not Financial Advice — Extended Disclaimer

All content, signals, indicators, data, AI-generated text, scores, rankings, alerts, and any other output produced by ScanEX is provided for informational and educational purposes only.

Specifically:

• No output from ScanEX constitutes a recommendation to buy, sell, hold, or otherwise transact in any cryptocurrency, token, digital asset, or any other financial instrument.
• Past performance of any signal, indicator, or data point does not guarantee or imply future results.
• Algorithmic signals and AI-generated analysis may be inaccurate, incomplete, delayed, or otherwise unreliable. You should not rely on them as the sole basis for any decision.
• Market data is sourced from third-party exchanges and may contain errors, delays, or gaps. ScanEX does not guarantee the accuracy, completeness, or timeliness of any data.
• The "Alex" AI feature generates responses using live market data and a third-party AI model. AI-generated analysis is inherently probabilistic and may be incorrect. It does not constitute financial advice under any circumstances.

Before making any investment or trading decision, you should conduct your own independent research and, if appropriate, consult a licensed financial adviser in your jurisdiction.

4. Risk Disclosure

Trading and investing in cryptocurrencies and digital assets carries substantial risk, including the possible loss of your entire investment. You acknowledge and accept that:

• Cryptocurrency markets are highly volatile. Prices can change rapidly and unpredictably.
• Cryptocurrency markets operate 24/7 and may be subject to manipulation, low liquidity, technical failures, and regulatory changes.
• Using signals or analytical tools does not eliminate trading risk and may create a false sense of confidence.
• You may lose more than you invest, particularly when using leverage or margin trading on external platforms.
• Regulatory status of cryptocurrencies varies by jurisdiction. It is your responsibility to ensure that your use of the Platform and any related trading activity complies with the laws of your country of residence.

You should never invest more than you can afford to lose.

5. Limitation of Liability

To the fullest extent permitted by applicable law:

• ScanEX, its owners, operators, employees, affiliates, and service providers shall not be liable for any direct, indirect, incidental, special, consequential, or punitive damages arising from your use of, or inability to use, the Platform.
• ScanEX shall not be liable for any trading losses, investment losses, lost profits, lost revenue, or financial harm of any kind, regardless of whether such losses were foreseeable or whether ScanEX had been advised of the possibility of such losses.
• ScanEX shall not be liable for any errors, omissions, interruptions, delays, or inaccuracies in market data or any other content provided through the Platform.
• ScanEX shall not be liable for actions taken by third-party exchanges, brokers, or other platforms that you use in connection with information obtained from ScanEX.

In jurisdictions that do not allow the exclusion or limitation of liability for certain types of damages, our liability shall be limited to the maximum extent permitted by applicable law.

6. No Warranty

The Platform and all content are provided on an "as is" and "as available" basis, without warranties of any kind, either express or implied, including but not limited to:

• Warranties of merchantability, fitness for a particular purpose, or non-infringement
• Warranties that the Platform will be uninterrupted, error-free, or free from harmful components
• Warranties regarding the accuracy, completeness, timeliness, or reliability of any data, signals, or content
• Warranties that any signal, indicator, or output will result in profitable trading outcomes

7. User Responsibilities

By using ScanEX, you confirm that:

• You are at least 18 years of age and legally capable of entering into binding agreements in your jurisdiction.
• Your use of the Platform is solely for informational and monitoring purposes, and not as the sole basis for any financial decision.
• You will not attempt to reverse-engineer, scrape, copy, reproduce, or redistribute any data, algorithms, or content from the Platform without our prior written consent.
• You will not use the Platform for any unlawful purpose or in any manner that violates these Terms.
• You are solely responsible for the security of your account credentials.

8. Licence and Use Restrictions

Subject to these Terms and payment of the applicable subscription fees, SCANEX DIGITAL LTD grants you a personal, non-exclusive, non-transferable, non-sublicensable and revocable licence to access and use the Platform for your own internal informational purposes only, on no more than the number of registered devices permitted by your subscription plan.

Your account and credentials are strictly personal. On team plans, access is limited to named members of your own organisation, within the device limit of your plan. Each individual using the Platform must be covered by a valid subscription.

Except with the prior written consent of SCANEX DIGITAL LTD, you must not:

• Share, sell, resell, rent, lease, lend, sublicense, or otherwise make your account, credentials, or access to the Platform available to any third party, whether for payment or free of charge.
• Operate, offer, or participate in any service through which third parties receive data, signals, alerts, screenshots, or any other output of the Platform — including signal groups, Discord or Telegram channels, newsletters, copy-trading arrangements, or paid communities.
• Publicly display, stream, broadcast, record, or otherwise communicate the Platform or its output to the public for commercial purposes, including on YouTube, Twitch, social media, in webinars, courses, or paid training materials.
• Use the Platform or its output to build, train, power, or operate any product or service that competes with the Platform or that commercially exploits Platform data.

Any breach of this section constitutes a material breach of these Terms and may result in immediate suspension or termination of your account without refund, without prejudice to any other rights or remedies available to SCANEX DIGITAL LTD, including claims for damages and an account of profits derived from the breach.

If you wish to feature ScanEX publicly — for example in editorial reviews, press coverage, or educational content — contact us at support@scanex.digital. Permission for good-faith, non-commercial editorial use is usually granted.

9. Subscription and Billing

Access to ScanEX requires a paid subscription. By subscribing:

• You authorize ScanEX to charge your payment method on a recurring basis according to your selected plan.
• The 7-day free trial requires a valid payment method. Your card will be charged on day 8 unless you cancel before that date.
• Subscription fees are non-refundable except where required by applicable law.
• We reserve the right to change pricing with reasonable notice.

10. Intellectual Property

All content, algorithms, software, designs, trademarks, and other materials on the Platform are the intellectual property of ScanEX or its licensors. You may not copy, reproduce, modify, or distribute any part of the Platform without our prior written consent.

11. Termination

We reserve the right to suspend or terminate your access to the Platform at any time, with or without notice, for any violation of these Terms or for any other reason at our discretion. Upon termination, your right to access the Platform ceases immediately.

12. Third-Party Services

The Platform integrates with third-party services including cryptocurrency exchanges, AI providers, and payment processors. We are not responsible for the availability, accuracy, or actions of these third parties. Your use of third-party services is subject to their respective terms and policies.

13. Governing Law and Disputes

These Terms shall be governed by and construed in accordance with the laws of England and Wales. Any disputes arising from these Terms or your use of the Platform shall be resolved through good-faith negotiation first, and if unresolved, shall be subject to the exclusive jurisdiction of the courts of England and Wales — except that, if you are a consumer, you retain any mandatory protections and rights to bring proceedings granted by the laws of your country of residence.

14. Severability

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.
